Membership Agreement

This E-Commerce Membership Agreement ("Agreement") sets out the terms and conditions governing the creation and use of customer accounts on the official Kayalar Jewellery website, including access to account-related features and services.

By completing the registration process and expressly accepting this Agreement through the relevant registration procedure at kayalarkuyumculuk.com, the user confirms that they have had the opportunity to read and understand these terms and agree to be bound by them, to the extent permitted by applicable law.

Creating a customer account is not necessarily a requirement for purchasing jewellery from Kayalar Jewellery. Where the website supports guest checkout, customers may place orders without registering for an account.

This Agreement governs account membership and related website services. Individual jewellery purchases are subject to the applicable sales agreement, pre-contractual information, payment conditions, shipping arrangements and mandatory consumer protection requirements.

1. Parties to the Agreement

This Agreement is entered into electronically between Kayalar Jewellery, the business operating the website, and the individual or legal entity registering for a customer account through kayalarkuyumculuk.com.

For the purposes of this Agreement, Kayalar Jewellery may be referred to as "Kayalar Jewellery", "we", "us" or "our". The registered account holder may be referred to as the "User", "Member" or "you".

2. Purpose and Scope of the Agreement

The purpose of this Agreement is to establish the general terms governing the creation, administration and use of customer accounts on the Kayalar Jewellery website, together with the respective rights and responsibilities of the parties in relation to account membership.

Membership may provide access to account-related services, such as managing personal information, reviewing order history and using other features supported by the website.

This Agreement does not replace the Distance Sales Agreement, mandatory pre-contractual information, Right of Withdrawal information, Cancellations, Returns & Exchanges Policy or other documents governing an individual product purchase.

When a Member places an order, the contractual rights and obligations relating to that purchase are determined separately by the terms presented during the relevant transaction and by applicable mandatory law.

For international customers, additional consumer protection, importation, payment or delivery requirements may apply depending on the destination and circumstances of the transaction.

3. Account Registration

Users may create a customer account by providing the information requested during registration, completing any required verification steps and accepting the applicable membership terms through the registration process.

Information provided during registration should be accurate, complete and kept reasonably up to date. Users should only register using information they are authorised to provide.

Where applicable, account registration must be completed by an individual with the legal capacity or appropriate authority to enter into this Agreement.

  • Members are expected to keep their registration and contact information accurate and current.
  • Accounts must not be created using another person's identity or personal information without proper authorisation.
  • Accounts associated with materially inaccurate, misleading or fraudulent information may be subject to appropriate verification or review.
  • Membership services must not be used for unlawful, fraudulent or otherwise prohibited activities.
  • Members should review the applicable terms and privacy information presented during registration.

Registration does not automatically guarantee access to every website feature or the availability of delivery and payment services in every country.

4. Account and Password Security

Members are encouraged to protect the email addresses, usernames, passwords and other credentials used to access their accounts.

Passwords and authentication information should not be shared with unauthorised individuals. We recommend choosing a strong password that is not used for other websites or online services.

If a Member becomes aware of suspected unauthorised access, unusual account activity or the possible compromise of login credentials, they should contact Kayalar Jewellery as soon as reasonably possible.

Account Security: Use a strong, unique password and keep your login credentials confidential. If you notice suspicious activity involving your account, please contact Kayalar Jewellery through our official communication channels.

Responsibility for unauthorised account activity will be assessed according to the circumstances, the actions of the parties and the applicable legal requirements.

Nothing in this Agreement automatically transfers responsibility for security failures attributable to Kayalar Jewellery or its service providers to the Member.

5. Membership Features and Services

Depending on the technical capabilities and configuration of our website, registered Members may have access to some or all of the following account-related features:

  • Placing orders and reviewing previous purchases.
  • Viewing or managing delivery and billing information.
  • Saving favourite jewellery items or wish lists.
  • Checking order status and available tracking information.
  • Updating personal details and account preferences.
  • Accessing available information about returns, exchanges or customer support requests.
  • Using other membership features that may be introduced or supported by the website.

Kayalar Jewellery may introduce new membership features, improve existing services or make reasonable technical and operational changes to the website.

Certain services may be temporarily unavailable due to maintenance, technical limitations or operational requirements.

Material changes affecting existing contractual rights will be handled in accordance with applicable law and the relevant notice or consent requirements.

6. Orders and Purchasing Transactions

Creating a customer account does not constitute a purchase commitment and does not oblige a Member to place an order.

Where a Member places an order, the purchasing process is governed by the applicable checkout information, sales terms and legal requirements.

Order processing may involve payment verification, product availability checks, confirmation of product specifications and other legitimate operational procedures.

The point at which a sales contract becomes binding is determined by the applicable checkout process, the terms presented to the customer and mandatory consumer protection law.

Before placing an order, customers should be given the opportunity to review the relevant product information, total price, available payment methods, applicable shipping charges and delivery conditions, as required by law.

Kayalar Jewellery does not offer instalment payment plans. Card purchases made through our online store are processed as single, full-amount transactions through supported payment methods.

Free shipping is available for deliveries within Türkiye. International shipping is subject to additional charges and is available only where suitable delivery arrangements can be provided.

International purchases may also involve customs duties, import taxes and other destination-specific charges. Applicable costs, responsibilities and purchasing conditions must be communicated as required by the relevant legislation before a purchase is completed.

7. Product Information, Prices and Availability

Kayalar Jewellery aims to provide clear and accurate information concerning the products offered through its website, including descriptions, photographs, prices, stock availability and relevant specifications.

However, technical errors, data transmission issues, stock synchronisation problems or other system-related circumstances may occasionally affect the information displayed.

Gold and jewellery prices may change due to fluctuations in precious metal markets, foreign exchange rates, product weight, gemstone characteristics, craftsmanship and other relevant factors.

The price and transaction details agreed during the applicable checkout process determine the terms of the purchase, subject to mandatory law.

Where an obvious technical or pricing error is identified, Kayalar Jewellery may contact the customer to explain the circumstances and discuss an appropriate resolution.

Any correction, cancellation or modification of an order must comply with the applicable contractual terms and consumer protection requirements. A confirmed purchase will not be cancelled arbitrarily merely because market prices have subsequently changed.

For international customers, the transaction currency and any relevant shipping charges should be reviewed before payment. Currency conversion costs or foreign transaction fees may also be imposed independently by the customer's bank or payment provider.

8. Member Responsibilities and Acceptable Use

Members are expected to use the website and their accounts lawfully, responsibly and with respect for the rights of Kayalar Jewellery, other users and third parties.

The following activities are prohibited:

  • Attempting to gain unauthorised access to another person's account or private information.
  • Interfering with the security, stability or normal operation of the website.
  • Introducing malicious software or using automated tools in a manner that damages, overloads or unlawfully interferes with the website.
  • Copying, reproducing or commercially exploiting protected website content without appropriate authorisation.
  • Providing fraudulent, misleading or unauthorised personal, account or payment information.
  • Engaging in activities that violate applicable laws or unlawfully interfere with the rights of Kayalar Jewellery or other parties.

Kayalar Jewellery may take proportionate and legally permitted action where there is a reasonable basis to believe that an account is being used for fraudulent activity, unauthorised access or another serious violation.

Any restriction or suspension of an account will be considered in light of the relevant circumstances, applicable contractual obligations and mandatory legal requirements.

9. Personal Data Protection and Privacy

Personal data collected or processed during account registration and subsequent account use is handled in accordance with applicable data protection legislation.

This includes Türkiye's Personal Data Protection Law No. 6698 (KVKK). Where applicable to particular processing activities, additional legal requirements, including the European Union's General Data Protection Regulation (GDPR) or other relevant privacy legislation, may also apply.

Personal information may be processed for legitimate purposes associated with account administration, order management, customer communication, security, legal compliance and other activities described in the relevant privacy notices.

Further information concerning the purposes of processing, applicable legal bases, recipients, international data transfers, retention periods and individual rights is provided in our Privacy Policy and relevant Personal Data Protection notices.

Acceptance of this Membership Agreement does not automatically constitute consent to every form of personal data processing. Where a particular activity requires separate, freely given and informed consent, that consent must be obtained through an appropriate mechanism.

Members may exercise applicable data protection rights using the procedures and contact information described in the relevant privacy documentation.

10. Marketing Communications and Consent

Creating a Kayalar Jewellery account does not automatically enrol a Member in promotional email, SMS or telephone marketing.

Where required by applicable legislation, permission for commercial electronic communications will be requested separately from acceptance of this Membership Agreement.

Marketing communications may include information about new jewellery collections, special offers, seasonal campaigns, promotional activities and other brand-related announcements.

Members may update their marketing preferences or withdraw previously granted consent in accordance with applicable law and the communication methods made available.

Withdrawal of consent for promotional communications does not necessarily prevent the sending of legitimate transactional messages, such as order confirmations, payment notifications and delivery updates, where permitted or required by law.

For further information, please review our Marketing Communications Consent page and the relevant privacy notices.

11. Intellectual Property Rights

The Kayalar Jewellery website contains trademarks, brand names, logos, product photographs, written content, design elements, graphics, page layouts, software components and other materials that may be protected by intellectual property legislation.

The relevant intellectual property rights belong to Kayalar Jewellery or their respective lawful owners.

Unless permitted by law or authorised by the relevant rights holder, website materials must not be reproduced, distributed, modified, commercially exploited or republished without appropriate permission.

Members may access and use website content for legitimate personal shopping and account-related purposes, subject to applicable law and these terms.

Accessing or viewing the website does not transfer ownership of intellectual property rights to the user.

12. Third-Party Websites and Services

Our website may include links to third-party websites or services, including payment providers, banks, delivery companies, social media platforms and other external service providers.

Third-party services may operate under their own terms of use, privacy notices and security procedures.

Members are encouraged to review the relevant conditions before using an external service or sharing personal information directly with a third party.

Kayalar Jewellery does not control every aspect of independently operated third-party websites and services.

However, nothing in this Agreement excludes responsibilities that Kayalar Jewellery may have under applicable law for payment processing, order fulfilment, contracted service providers or other aspects of transactions for which it remains legally responsible.

13. Website Security and Service Availability

Kayalar Jewellery recognises the importance of maintaining a secure, reliable and accessible online shopping environment.

We aim to support website security and operational continuity through appropriate technical and organisational practices.

Website access or certain account features may occasionally be interrupted by scheduled maintenance, technical failures, hosting problems, network disruptions, cybersecurity incidents or circumstances outside our reasonable control.

Where necessary, some services may be temporarily restricted to carry out security improvements, system maintenance or operational updates.

Although continuous availability cannot be guaranteed, we aim to address service interruptions responsibly and restore affected functionality where reasonably possible.

These provisions do not exclude any liability or consumer rights that cannot lawfully be restricted.

14. Updating Membership Information

Members should keep their account details reasonably accurate and up to date, particularly where information is used for order management, delivery arrangements, billing or customer communication.

Relevant information may include the Member's name, telephone number, email address, delivery address and other details maintained within the account.

Incorrect or outdated information may cause unnecessary delays, difficulties with order verification or unsuccessful delivery attempts.

For international orders, customers should also ensure that the destination country, postal code and any relevant customs or recipient information are accurate.

Members are encouraged to review their details periodically and contact Kayalar Jewellery if assistance is needed to correct account information.

15. Account Closure and Termination

Members may request the closure of their customer account through the account management features available on the website or by contacting Kayalar Jewellery through the official communication channels provided below.

Where applicable law grants additional rights concerning account deletion or termination, those rights will be respected.

Closing an account does not necessarily require the immediate deletion of all associated information.

Certain transaction records, invoices, accounting information and other documentation may need to be retained for the periods required by tax, consumer protection, accounting or other applicable legislation.

Where an account is reasonably suspected of being used for fraud, unauthorised access, serious security threats or material contractual violations, Kayalar Jewellery may take appropriate and proportionate protective measures.

Account suspension or termination will be handled in accordance with applicable law, taking into account the circumstances and any relevant requirements concerning notice, fairness and the protection of existing customer rights.

Termination of membership does not automatically extinguish outstanding contractual obligations or statutory rights relating to purchases made before account closure.

16. Changes to the Membership Agreement

Kayalar Jewellery may review and update this Agreement to reflect changes in applicable legislation, website functionality, security requirements, service arrangements or other legitimate operational needs.

Updated terms may be published on the website and will apply prospectively to the extent permitted by applicable law.

Where changes materially affect Members' contractual rights or obligations, appropriate notice will be provided and any additional consent or acceptance required by law will be obtained.

Changes to this Agreement will not retrospectively remove statutory rights or alter completed purchases in a manner prohibited by applicable consumer protection legislation.

Members are encouraged to review the currently published terms from time to time. However, merely publishing revised terms does not replace any legally required notification or agreement procedure.

17. Electronic Records and Communications

Electronic records associated with membership registration, account activity, order placement, transaction confirmations and related website interactions may be retained where necessary for legitimate purposes and in accordance with applicable legislation.

Such purposes may include account administration, transaction management, security monitoring, compliance with legal obligations and the establishment, exercise or defence of legal claims.

Electronic records may be considered as evidence in the event of a dispute, security investigation or transaction-related enquiry, subject to applicable rules concerning evidence, authenticity and admissibility.

Nothing in this Agreement makes records maintained by Kayalar Jewellery automatically conclusive or prevents a Member from challenging their accuracy or legal significance.

The retention and processing of personal information contained in electronic records remain subject to the relevant privacy and data protection requirements.

18. Consumer Rights and Statutory Protection

Nothing in this Agreement shall be interpreted as removing, excluding or restricting mandatory consumer rights arising under Türkiye's Consumer Protection Law No. 6502 or other legislation applicable to the relevant transaction.

Rights concerning withdrawal, cancellation, defective or non-conforming products, refunds, delivery and other consumer matters are addressed separately under the relevant sales documentation and applicable law.

For international customers, mandatory consumer protection legislation may apply depending on the destination country, the manner in which the goods or services are offered and the circumstances of the purchase.

Where European Union, United Kingdom or other relevant consumer protection rules apply, this Agreement does not prevent the consumer from relying on legal protections that cannot lawfully be excluded by contract.

Membership-related conditions and product purchasing conditions are separate. Accepting this Agreement does not constitute a waiver of statutory rights relating to any existing or future purchase.

19. Complaints and Dispute Resolution

Kayalar Jewellery aims to address customer concerns through clear communication and a responsible approach to complaint handling.

Members are encouraged to contact us through our official communication channels if they have questions, complaints or concerns relating to their membership, account access or a purchase made through the website.

Where a consumer dispute arises in Türkiye, the competent Consumer Arbitration Committees or Consumer Courts may have jurisdiction according to the applicable statutory thresholds, procedural rules and legal requirements.

For international transactions, the applicable dispute resolution procedures, competent courts and mandatory consumer protections may depend on the relevant jurisdiction and the circumstances of the contractual relationship.

Where mandatory rules protect a consumer's right to pursue proceedings or rely on the law of their country of residence, those protections cannot be excluded merely through this Membership Agreement.

Nothing in this provision requires international consumers to waive rights to access a competent court or statutory dispute resolution mechanism where such rights cannot lawfully be restricted.

The parties may seek an amicable resolution through direct communication where appropriate, without limiting access to legally available remedies.

20. Acceptance and Entry into Effect

This Membership Agreement enters into effect between Kayalar Jewellery and the Member when the registration process has been completed and the Agreement has been validly accepted through the applicable electronic procedure.

The Agreement applies to the membership relationship and the account-related services made available in accordance with its terms.

Members are expected to comply with the applicable membership conditions while using their accounts, subject to any amendments validly introduced in accordance with this Agreement and mandatory law.

The conclusion of this Agreement does not automatically constitute a purchase, consent to marketing communications or consent to personal data processing activities that require a separate legal basis.

Product orders are governed by their own applicable sales terms and mandatory consumer protection requirements.
